Terms & Conditions
Promotion open to residents aged 12 or over of, and clubs or organisations based in, the UK or the Republic of Ireland, excluding employees of Mars Snackfood, their families, agents and anyone else professionally connected with this promotion. Individual applicants aged between 12 and 17 must have parental/guardian permission before submitting an application.
To submit an application for a donation from the Mars Refuel Fund:
visit

and complete your details (name, address, email address and details, if applicable, of your club, sporting group or community organisation) in the online entry form;
describe in no more than 200 words how a donation from the Mars Refuel Fund could help you or your club to play longer and fulfil its sporting potential or achieve its fund-raising endeavours; and
submit your on-line entry form ("Application").
Applications must be submitted between 1 July 2008 and midnight on 31 December 2008. A maximum of one Application per person/club/organisation is permitted. Subsequent Applications by the same person/club/organisation whether based on the same, or a different purpose or fund-raising activity will be rejected. Applications (including any copyright in them) become the property of the Promoter and can be used by the Promoter for any purpose.
Proof of submitting an Application is not proof of receipt by the Promoter. The Promoter accepts no responsibility for entries that are lost, delayed or destroyed due to any technical failure or otherwise.
The Promoter will make donations totalling up to £10,000 each month to the most deserving Applications selected that month ("Monthly Fund"), with a maximum donation of £500 (€650 for ROI resident/ based applicants) to be awarded per successful applicant ('Support Donations'). Unsuccessful Applications (but which are in all other respects valid) submitted in any month will be carried forward to be re-considered by the judges in subsequent months of the promotion. Monthly judging will take place 3 working days after the end of each month, with the final judging on 3 January 2009.
Applications will be judged monthly by an independent panel of judges appointed by the Promoter. Each Application will be individually assessed and the judges will determine, in their absolute discretion, the most deserving Applications each month and the value of the Support Donation to be awarded to each of the selected Applications. The judges' decision is final and no correspondence will be entered into. The judges will base their decisions on a number of factors, including the purpose for the Support Donation and any fund-raising activity being carried out by the Applicant. The Promoter reserves the right not to allocate the entire Monthly Fund where the judges consider that the quality of the Applications received in the relevant month is too low or the causes and purposes are not sufficiently worthy. Where the Monthly Fund is not allocated in its entirety in any month, the balance will be carried over to the following month, for allocation by the judges in accordance with these terms and conditions. In the event that the December Monthly Fund is not allocated in its entirety, the balance will remain the property of the Promoter and will not be distributed as part of this Promotion.
Successful recipients of Support Donations will be contacted by email within 28 days of the end of the relevant month in which they were successful. Recipients will be requested to nominate their preferred payment method for their Support Donation. A parent/guardian will be required to nominate the payment method for an Applicant aged 17 or under. Support Donations in cash form will not be available.
The recipients' details (name and county and country only) will be available by sending a SAE marked 'Mars Refuel Fund Support Donations' to Escapade PR, Floor 3, Imperium, Imperial Road, Reading, RG2 0TD after 31 January 2009.
Recipients of Support Donations agree to participate in any promotional activities requested by the Promoter. By submitting an Application, successful applicants (or the parent/guardian who approved the Applicant's participation, if the applicant is under 18 years of age), consent to the Promoter using the recipient's name, image and description of their purpose and/or fundraising activity, for advertising and publicity purposes.
Each Support Donation is non-transferable. The Promoter may, in its absolute discretion, award the Support Donation to the recipient's parent/guardian if he/she is under 18 years of age.
The Support Donation provided to the recipient should only be used for the purpose(s) declared in the original Application, unless the Promoter agrees a change of use with the recipient in writing. The Promoter reserves the right to reclaim the Support Donation (or any part of it) not used for the purpose(s) indicated in the recipient's original Application or for the purposes specified in any agreed change of use.
The Promoter accepts no responsibility for any losses incurred by a recipient in using the Support Donation. The Promoter accepts no responsibility for the acts or omissions of third parties. A recipient of a Support Donation shall be responsible for any tax liability arising from receipt or use of such Support Donation.
The Promoter reserves the right to cancel, amend, terminate, or temporarily suspend this promotion in the event of any unforeseen circumstances outside its reasonable control, with no liability to any applicant or any third party.
The Promoter reserves the right to suspend or withdraw the promotion in the event of a technical fault which prevents applications being received in accordance with these terms and conditions. In such circumstances, the Promoter shall have no liability to any applicants.
For UK residents/clubs/organisations, this promotion is governed by, and shall be construed in accordance with, the laws of England and Wales. For Irish residents/clubs/organisations, this promotion is governed by, and shall be construed in accordance with the laws of the Republic of Ireland. By taking part in this promotion applicants agree to be bound by these terms and conditions. In the event of a failure to comply with these terms and conditions, the Promoter shall be entitled in its absolute discretion to refuse to make a Support Donation or reclaim any Support Donation (in whole or in part) which has been made.
